This Privacy Policy describes issues related to the use of the www.systemhelpdesk.pl website (hereinafter referred to as the "Portal").
Our goal is to ensure your sense of security on our Portal, which is why your privacy and data protection are very important to us. We assure you that your data will be processed in a transparent and fair manner, and we will make every effort to handle it with due care and responsibility.
This Privacy Policy is intended to inform you about how we use your personal data, in respect of which we meet all the requirements of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (hereinafter referred to as "GDPR").
1. Controller information
The controller of your personal data within the meaning of the GDPR is Debesis Sp. z o.o., Geodetów 176 Street, 05-500 Piaseczno (hereinafter referred to as the "Controller"). 2. Purposes and legal grounds for data processing
Your personal data may be processed by the Controller on the basis of:
a) necessity for the performance of a contract or to take action before its conclusion (Art. 6(1)(b) GDPR), separately for the purpose of:
- providing newsletter services;
- using contact forms;
- enabling access to materials related to the topics covered on the Portal;
b) consent (Art. 6(1)(a) GDPR), for the purpose of conducting marketing of entities cooperating with the Controller;
c) the legitimate interest of the Controller (Art. 6(1)(f) GDPR), separately for the purpose of:
- marketing of the Controller's own products and services, including for analytical and profiling purposes, where the legitimate interest of the Controller is to conduct direct marketing of its own products and services. Data profiling is aimed at preparing an offer of Debesis Sp. z o.o. products that takes into account the preferences of Portal users;
- using the contact forms made available by the Controller on the Portal, where the legitimate interest of the controller is to take care of Portal users and provide answers to questions asked;
- defense against possible claims, where the legitimate interest of the Controller is to pursue or defend claims.
3. Transfer of personal data
Data may be transferred to entities processing it on our behalf under agreements concluded with the Controller, but only for the purpose and to the extent necessary for the implementation of the above-mentioned purposes, including, among others, entities providing IT services or other services ensuring the proper functioning of the Portal, with such entities processing data only in accordance with the instructions of the Controller.
In particular, the recipients of your data may be the following categories of entities:
• Portal hosting service provider — for the technical maintenance of the website;
• Google Ireland Limited — for Google Tag Manager and Google Analytics 4 services (traffic statistics, advertising performance indicators);
• Smartsupp.com s.r.o. (Czech Republic) — for the website chat service and the cookie consent banner;
• Google Ireland Limited — for the reCAPTCHA service, if the contact form is secured by it;
• email service operators — for handling inquiries sent through the contact form.

We transfer your data only to entities located within the European Economic Area and therefore subject to strict EU data protection regulations, or to those bound by an appropriate security standard. The transfer of data to third countries is not currently practiced or planned by us.
4. Period of storage of personal data
We process your personal data only for the period necessary to fulfill the purpose of their storage or as long as required by law, in particular until the expiry of any claims or the expiration of the archiving obligation arising from legal provisions, including the obligation to store accounting documents.
In the case of processing personal data for the purpose of providing newsletter services, using contact forms, and enabling access to materials related to the topics covered on the Portal, your personal data will be processed for the period necessary to provide this service, until you opt out.
If personal data is processed based on the consent you have given, your data will be stored until it is withdrawn. You can withdraw consents given on the website at any time, including consent to data processing for marketing purposes of entities cooperating with the Controller. Withdrawal of consent for processing will not affect the lawfulness of processing carried out before its withdrawal.
In the case of processing your data based on the legitimate interest of the controller, the Controller will stop processing the data earlier if you effectively object to the processing of data.
5. Your rights
a) Right of access to data
You have the right to obtain information about your personal data stored by us, including a copy of this data.
b) Right to rectification of data
You have the right to request rectification of your personal data that is inaccurate. Taking into account the purposes of processing, you have the right to request the completion of incomplete personal data, including by submitting a supplementary statement.
c) Right to erasure of data
You have the right to request the deletion of your personal data stored by us in the following cases:
• your personal data is no longer necessary for the purposes for which it was collected,
• you have withdrawn the consent on which the processing is based and there is no other legal basis for the processing,
• you have objected to the processing and there are no overriding legitimate grounds for the processing, or the objection concerns the processing of data for direct marketing purposes,
• personal data has been processed unlawfully,
• personal data must be deleted in order to comply with a legal obligation provided for in Union law or national law,
• personal data has been collected in connection with the offer of information society services referred to in Art. 8(1) GDPR.
d) Right to data portability
You have the right to receive, in a structured, commonly used machine-readable format, the personal data concerning you that you have provided to us, if the processing of this data is based on consent or contract and is carried out in an automated manner.
If you request that this data be transferred to another data controller, this will be done, if there is such a technical possibility.
e) Right to restriction of data processing
You have the right to request that the processing of your personal data be restricted in the following cases:
• you contest the accuracy of personal data – for a period enabling us to verify the accuracy of this data,
• the processing is unlawful and you oppose the deletion of personal data, requesting instead the restriction of its use,
• we no longer need the personal data for the purposes of processing, but you need it for the establishment, exercise or defense of claims,
• you have objected pursuant to Art. 21(1) to the processing – until it is determined whether the legitimate grounds on the part of the controller override the grounds for the objection.
f) Right to object to processing
If your personal data is processed based on the legitimate interest of the controller, you have the right to object to the processing at any time, in accordance with Art. 21 GDPR.
g) Right to withdraw consent
You have the right to withdraw your consent to the processing of personal data at any time. The withdrawal of consent for processing will not affect the lawfulness of processing carried out before its withdrawal.

The security of personal data is a priority for us; however, if you believe that we are violating GDPR provisions when processing your personal data, you have the right to lodge a complaint with the President of the Personal Data Protection Office.
6. Cookies
a) What are cookies and what are they for?
Cookies are small text files that are stored on your device when you visit the Portal. These files are sent by the website to the browser. Each cookie has an anonymous identifier and allows the device on whose memory it was stored to be identified for a specified time (the time after which the cookie will be deleted). Cookies are saved to recognize your device, understand your preferences, and collect information about your previous activities on the Portal.

Please note that if you do not consent to the use of cookies, you will not be able to fully use some elements of the Portal, e.g. you will not be able to use the Portal's personalization features.

In order to ensure that the Portal's Privacy Policy continually meets the current requirements imposed by legal provisions, we reserve the right to make changes to it at any time.
